(h) Posting surveys, contests, chain letters or pyramid schemes;

(i) Impersonating another person;

(j) Uploading or distributing files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer; or

(k) Allowing any other person or entity to use your identification for posting or viewing comments.

My TV20 Detroit reserves the right to review postings on its Service, to remove any postings, and to terminate your ability to post to the Service at any time without notice, in its sole discretion. My TV20 Detroit also reserves the right to disclose any information necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part.

WSBT TELEVISION, INC., DISCLAIMS TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANY AND ALL SUCH REPRESENTATIONS AND WARRANTIES.

WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, My TV20 DISCLAIMS TO THE MAXIMUM EXTENT PERMITTED BY LAW ANY AND ALL (a) WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, (b) WARRANTIES AGAINST INFRINGEMENT OF ANY THIRD PARTY INTELLECTUAL PROPERTY OR PROPRIETARY RIGHTS, (c) WARRANTIES RELATING TO DELAYS, INTERRUPTIONS, ERRORS, OR OMISSIONS IN THE SERVICE, OR ANY PART THEREOF, (d) WARRANTIES RELATING TO THE TRANSMISSION OR DELIVERY OF THE SERVICE, AND (e) WARRANTIES OTHERWISE RELATING TO PERFORMANCE, NONPERFORMANCE, OR OTHER ACTS OR OMISSIONS BY WTVH-TV CBS 5, OR ANY THIRD PARTY.

FURTHER, AND WITHOUT LIMITING THE GENERALITY OF ANY OF THE FOREGOING, THERE IS NO WARRANTY THAT THE SERVICE WILL MEET YOUR NEEDS OR REQUIREMENTS OR THE NEEDS OR REQUIREMENTS OF ANY OTHER PERSON.

12. Limitation of Liability. Neither My TV20, nor any party involved in creating, producing or delivering this Service, or on any website linked to this Service, shall be liable in any manner whatsoever for any direct, incidental, consequential, indirect or punitive damages arising out of your access, use or inability to use this Service or any site linked to this Service, or any errors or omissions in the content thereof.

My TV20 reserves the right to alter the content of this Service in any way, at any time, for any reason, without prior notification, and will not be liable in any way for possible consequences of such changes. These limitations apply whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if My TV20 has been advised of the possibility of such damage. Because some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, My TV20's liability in such jurisdictions shall be limited to the extent permitted by law.

13. Indemnification. Upon a request by My TV20, you agree to defend, indemnify and hold harmless My TV20, and its subsidiaries, affiliates, officers, agents, co-branders or other partners and employees from all liabilities, claims, and expenses, including reasonable attorneys' fees, made by any third party due to or arising out of content you submit, post to or transmit through this Service, your use of the Service, your violation of this Agreement or your violation of any rights of another.

14. Choice of Law and Forum. This Agreement shall be governed by and construed in accordance with the laws of the State of Indiana, excluding its conflict of law rules. You and My TV20, expressly agree to submit to the exclusive jurisdiction and venue of the courts in St. Joseph County, Indiana, in all disputes arising out of or relating to the use of this Service.

15. Severability and Integration. Unless otherwise specified herein, this Agreement constitutes the entire agreement between you and My TV20, and governs your use of this Service, superseding any prior or contemporaneous communications and proposals (whether oral, written or electronic) between you and My TV20, If any portion of this Agreement is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intention of the parties, and the remaining portions shall remain in full force and effect.

16. No Waiver. The failure of My TV20 to enforce any provisions of this Agreement or respond to a breach by you or other parties shall not in any way waive its right to enforce subsequently any terms or conditions of this Agreement or to act with respect to similar breaches.

17. No Professional Advice. Any information supplied by any employee or agent of My TV20, whether by telephone, e-mail, letter, facsimile or other form of communication, is intended solely as general guidance on the use of the Service, and does not constitute legal, tax, accounting or other professional advice. Individual situations and state laws vary and users are encouraged to obtain appropriate advice from qualified professionals in the applicable jurisdictions.

18. Miscellaneous. You agree that no joint venture, partnership, employment or agency relationship exists between you and My TV20 as a result of this Agreement or your use of this Service. Nothing contained in this Agreement is in derogation of My TV20's right to comply with governmental, court and law enforcement requests or requirements relating to your use of this Service or information provided to or gathered by My TV20, with respect to such use. A printed version of this Agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this Agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

19. Termination. My TV20 reserves the right, in its sole discretion, to terminate your access to all or part of this Service, with or without notice.
