DETROIT, MI (My TV20 News at 10) --- Jayne Rowse and April Deboer may be closer to adopting each other's children.

A federal judge has refused to dismiss the lawsuit filed by the couple from Hazel Park challenging Michigan's ban on adoption by unmarried couples.

U.S. District Judge Bernard Friedman is expected to set a trial date during a July 10 hearing.

Friedman's decision comes five days after the U.S. Supreme Court tossed out part of the Defense of Marriage Act that has prevented married gay couples from receiving tax, health and retirement benefits.
